German Spends 31.000 Euro on Mobile data during his holiday, now he has to repay his employer.

The use of a UMTS card, during the holiday in Croatia, can end up with and Astronomic bill, a German salesperson, working for a company producing fitness equipment, was at the labour court in Frankfurt am Main, verdict to repay his employer 31.000 Euro, the fact that the company had not explicitly forbidden the employee the private usage of the laptop during the holiday, was according to the court not relevant.

The employee should have checked it the usage of the UMTS card in Croatia, would lead to any extra cost.

The employee brought Laptop and UMTS card with him to Croatia, here he used laptop for extensive surfing on the internet, as the company’s Flat rate subscription was only valid for the usage within Germany, the company received a bill of 48.000 Euro, after negotiating with the telecom company, the bill was reduced to 31.000 Euro. At the labour court in Frankfurt, the company got court decision that the now former employee, has to repay the 31.000 Euro to the company. According to the court decision the employee, was responsible for checking if any extra cost would occur by the usage of the UMTS card in a foreign country, especially as the company could prove that he did not conduct any work during his holiday.
